The Massachusetts Commission Against Discrimination (MCAD) is the independent state agency that enforces the Massachusetts anti-discrimination laws in employment, housing, education, credit, and public accommodations by investigating, prosecuting and adjudicating complaints of discrimination. The MCAD also offers remedial and preventative training, and publishes resources online such as model policies, posters, and guides. The MCAD is seeking a committed and dedicated individual to fill the role of Attorney Advisor in our Housing Division. As a member of the Housing Investigations Division, Attorney Advisors (AAs) are responsible for advising compliance officers and other staff members on legal questions and issues; ensuring proper substantive analysis on all investigative cases; deciding motions in cases that are assigned in the Division, and reviewing drafts of recommendations for dispositions and drafting legal documents, including investigative Orders and dispositions. Incumbents may assist in the informal resolution of claims. Incumbents may conduct special investigations in cases assigned to them and prepare recommendations to the Investigating Commissioner regarding dispositions of those cases. Incumbents may be appointed to prosecute complaints in which probable cause has been found. They will also provide information to the public on agency functions, rules and regulations; conduct preliminary hearings on appeals from findings of Lack of Probable Cause; and perform related work as required. This position will be primarily responsible for the aforementioned duties and responsibilities in the Investigations Division Housing Unit. /_Duties and Responsibilities (these are a general summary and not all inclusive):_/ Act as a resource for the agency with respect to housing discrimination as well as general housing law. Communicate with other agencies including, but not limited to, the U.S. Department of Housing and Urban Development (HUD) with respect to MCAD's position on questions of Housing Discrimination law. The Attorney Advisor is assigned to the Housing Unit team consisting of Compliance Officers, the supervisor of the Compliance Officers and the Housing Unit Director. Makes recommendations to the Investigating Commissioner on all motions in cases assigned to the Housing Unit and drafts related Orders. Reviews motions and dispositions from other Investigative Units as assigned. Reviews all Housing Unit draft dispositions to advice on the adequacy of the investigation conducted and the legal sufficiency of the recommendations. Review cases with the intent of identifying novel legal issues, which may be of interest to the Commission in establishing new law or public policy. Through their supervisor, the Attorney Advisor will refer those cases to the Office of the General Counsel for consideration for full Commission review. Conduct preliminary hearings on appeals from findings of Lack of Probable Cause and review complaints through the Intake process. May conduct special investigations in assigned cases and prepare recommendations to the Investigating Commissioner regarding dispositions of assigned cases. The Attorney Advisor may advise the Commission on the feasibility the bringing of Commission initiated complaints and participate in their prosecution in the event that such complaints are brought. May participate in Alternative Dispute Resolutions sessions as a Mediator or Conciliator. May serve as Attorney of the Day, conducting complaint review and other duties in rotation, when and as assigned. The Attorney of the Day answers inquiries from the public regarding rights and responsibilities under c.151B. also provide information to the public on agency functions, rules and regulations. Perform other related investigative and administrative duties and functions as required by the Commission. First consideration will be given to those applicants that apply within the first 14 days. MINIMUM ENTRANCE REQUIREMENTS: Applicants must have a Juris Doctor (JD) degree, admission to the Massachusetts Bar and some experience in legal research, legal writing, and legal procedures and processes.
